These terms apply to your use of the Cutroom app and website. By creating an account or using the app you agree to them. If you don’t agree, don’t use the service. They work together with the Privacy Policy, which explains how we handle your data.
1. Who can use it
You must be 13 or older. If you are under 18, use the app with a parent or guardian’s consent. You confirm the information you provide is true.
2. What Cutroom does
The app shows one photo or video from your gallery at a time so you can decide: delete, keep, favorite or skip. Items marked for deletion wait in a session bin until you confirm. The app also offers an optional safety backup, usage stats, personalization and the Premium subscription.
Features and limits may differ between the free plan and Premium and between platforms. We describe the main ones on the plans screen.
3. Your account
You can clean your gallery without an account. An account (by email, with a one-time code) is needed for backup, to use Premium on several devices and for the invite program. You are responsible for keeping access to your email and for everything that happens in your account. Tell us if you think someone accessed it without permission.
4. Your photos and videos
Your photos and videos remain yours. We don’t access or upload them, except those you choose to keep in the backup. For the backup you give us a limited, temporary license to store those copies and return them to you, and nothing else.
Deletions are carried out by you, through your device’s system: on iPhone, items stay for 30 days in “Recently Deleted”; on Android they go to the gallery’s trash, as the system defines. Review carefully before confirming and use the backup if you want a safety net. You are responsible for the decisions you make in the app.
5. Backup
The backup is a temporary safety net, not permanent storage. Items expire on their own: 7 days on the free plan (up to 50 items) and 30 days on Premium (up to 3,000 items). After that they are deleted and cannot be recovered. We warn you before items expire if you allow notifications.
There are limits on quantity, size and file type. We don’t guarantee the backup will be available without interruption.
If you turn on end-to-end encryption, keeping the recovery code is your responsibility: without it and without the device, not even we can open or recover the encrypted backups.
6. Plans and payments
Premium is a monthly, quarterly or yearly subscription billed by the App Store or Google Play, at the price and currency shown in the store. It renews automatically until you cancel in your store settings, with the minimum notice the store defines. We may offer free trial periods; when they end billing starts unless you cancel.
Payments, refunds and cancellations follow the store’s rules (and consumer protection law where applicable). We have no access to your payment details. We may change prices for new subscriptions and, for existing ones, with the notice and consent the store requires.
7. Invite and earn
The program works like this, and the rules also show in the app:
- You share your code; your friend creates an account and applies the code within 7 days.
- An invite counts when your friend makes a first paid subscription (the free trial doesn’t count) and 14 days pass without a refund.
- For every 5 invites that count you earn 365 days of Premium, up to 2 rewards per 12 months. If you already have a paid subscription, the reward starts when it ends.
- You can’t invite yourself, nor with the same account, device or email. Fraudulent invites are disqualified and the reward may be revoked.
- The reward is Premium access, not money, and isn’t transferable. We may change the program for new invites, telling you in the app.
8. Acceptable use
You agree not to:
- use the app for anything unlawful or to violate other people’s rights;
- try to bypass plan limits, the invite program or the service’s security;
- reverse engineer, copy or resell the app, except where the law allows;
- upload to the backup content you have no right to keep.
9. Intellectual property
The app, the Cutroom brand, the design and the code are ours or our licensors’. We give you a personal, limited, revocable, non-exclusive license to use the app under these terms.
10. Availability and changes
We work to keep the service available but it may be interrupted. We may change or end features; when a change affects something you paid for, we will tell you and treat it fairly.
11. Ending your use
You can delete your account anytime in Settings → Privacy and data → Delete account (and cancel the subscription in the store). We may suspend or end accounts that break these terms, with notice when possible.
12. Liability
The app is provided as is. To the extent the law allows, we aren’t liable for indirect damages or for losses caused by your decisions in the app, by failures of the device’s system or by third-party outages. Nothing here limits rights the law gives you as a consumer or liability the law doesn’t allow to be limited.
13. Governing law and venue
These terms are governed by Brazilian law. For consumers, the courts of your domicile are chosen; in other cases, the courts of Cutroom’s seat, without prejudice to rights guaranteed by the law of your country.
14. Changes to these terms
We may update these terms. When a change is significant we tell you in the app before it takes effect. Continuing to use the service afterward means you accept the new version.
